Dr. Michael Borack is Judge Ronald Panioto's neighbor and Court Appointed Parental Alienation Syndrome expert. As such, his opinion was inappropriately afforded tremendous weight by Panioto's PAS Court. Eighteen months after his original report and only after failing to quash his deposition, Dr. Michael Gene Borack finally admitted in deposition:
"I'm not an expert, a specialist, in assessing children as to whether or not they've been sexually abused."
Up until that deposition moment, Dr. Michael Borack had bluffed his way through the entire Thibodeaux family evaluation.
Borack had absolutely no business being involved in this or any other child sexual abuse evaluation. Hamilton County has appointed Borack in nearly 30 other child custody evaluation cases affecting nearly 100 Cincinnati children. His career from Boston to Cincinnati to Kentucky and soforth is checkered with unethical conduct. Unethical potholes everywhere. He is reckless and destructive.
As the "court appointed" evaluator in this case, Michael Borack single-handedly reversed a true child sexual abuse expert, Dr. Jacqueline Kowalski, who had concluded with "psychological certainty" that the father in this case had abused his daughter.
Possessing no ability to assess child abuse, Borack commanded two Cincinnati child therapists, Drs. Barbara Boat & Erna Olafson, to "de-program" the children, as if they had been brainwashed into believing they were abused. When the therapists balked, Borack attempted to intimidate them.
On this page, read below the non-expert in child sexual abuse - though expert in PAS - Dr. Michael Borack bully his way through the case. What is sad for these children is that Borack and the court (read Panioto) failed to protect these children for over four years, and most of the following Borack recommendations were in effect from September 2000 until November 2004.

A Little Boy Complains
 
The protective mother, stung by the court PAS evaluator Michael Borack's April 2000 reports, wrote a very politely worded letter to the suspected child molester asking him to stop physically bathing their 7 1/2 year old son. These bathing sessions were traumatic for the boy, who begged his mother to do something. Despite kissing the ass of an abuser (try doing that even once) the letter backfired against the protective mother as his attorney Dominic Mastruserio and PAS court evaluator Dr. Michael Borack combined to squelch further allegations. Borack could and should lose his license for the way he handled this allegation.
"The father gave me a copy of the letter, (which was later supplied by [the mother's] counsel). It reads,
'(The boy) has also said, 'I have asked Dad four times to not give me baths anymore but he does not listen to me.' (The boy) has been taking showers at my residence for nearly two years and is capable of washing his private parts without assistance. Please allow (the boy) to take showers. The only thing he needs help with is the water temperature. (The boy) is approaching his eighth birthday and his right to privacy ought to be respected.'"

The father's attorney Dominic Mastruserio used the bathtub allegation to reinvolve Panioto's PAS evaluator Michael Borack. Sure enough, Borack did not report the allegation as mandated by law to Children Services. Nor did Borack investigate it himself - he couldn't - he wasn't expert, though he told no one about that. Instead Borack used the bathtub allegation as the pretext for yet another punishing round of recommendations against the mother which will be shown later below.
According to Dr. Gerald Koocher, an Associate Professor at Harvard Medical School, former Chief Psychologist at Boston's Children's Hospital, former Vice-Chairman of the APA Ethics Committee and currently a member of the APA Board of Directors who co-authored a 544 page book on Ethics, Dr. Michael Borack's August 2000 PAS report "screams" for a follow-up to the bathtub allegation. But Borack writes nothing about it.
Instead Borack unethically demanded that the children be deprogrammed.

The abused little girl had been three years old for an additional eight months after her last visit with Dr. Kowalski. So how could Dr. Boat know that the non-coached "sexual touching" that she was now hearing, which happened when the girl was three, was not a new allegation of abuse? She couldn't know. And she didn't try to find out. And she didn't report it as mandated by law to Children Services.
This whole business of gee, "one of the touching events happened when she was three and that now she is four years old" is really rather stupid. Is it okay to be molested at three years old? It's hard to make sense of Boat's bizarre statement or follow her reasoning process. This is what happens when a cancer (i.e. Borack) is introduced into the process. Borack had sternly warned Drs. Boat & Olafson not to let their "de-programming" and "intervention" "devolve" into another investigation. What an incredibly odd thing for a non-expert to advise true experts.
Most likely because of this website's exposure of both the renegade Borack and Zuberbuhler's PAS parenting division, Dr. Boat and every other child abuse expert in Cincinnati now refuse any involvement with Hamilton County's PAS court. Panioto laments that. We say he has himself to blame.
Dr. Boat ignored a subpoena at the mistrial in February 2004 because of illness and again in October 2004 because of ... well we don't know why? Even though she knew about the final trial, her attorney said that she was in North Carolina. Was she hiding? We think so. Did Dr. Boat allow the non-expert Borack to influence her therapy sessions and now cannot adequately explain herself to a judge? Sure looks that way.
Did Borack's commands and tirades derail a true investigation of child sexual abuse? Was Borack fearful that Drs. Boat & Olafson would validate the abuse allegations? Indeed, if handled properly, which it most certainly was not, the girl's disclosures should have vindicated the mother one month after losing custody to the abuser, who then went on to maintain custody.
How seriously did Dr. Boat take the girl's disclosures? Very seriously. Just as Dr. Kowalski had done before her, Boat tested the child for coaching and determined that she had not been.
Borack's so-called deprogramming and intervention stopped on a dime. However, when it came time to write a recommendation, Dr. Boat claimed that because everybody was now getting along so well that an "unorthodox" 50/50 arrangement would work. Hellooooo? Are you daft?
While it would be easy to suggest that Borack's incessant pressure influenced Boat's "unorthodox" position, the fact of the matter is that in another highly contentious custody battle in South Carolina, Dr. Barbara Boat recommended exactly the same thing ... 50/50. The unorthodox appears more orthodox. Call her fifty-fifty Barbara. Expert at getting disclosures and absolutely clueless what to do next.

Borack Says Supervise The Mother

Within days after learning that the little girl had disclosed possible sexual abuse to the very people assigned to deprogram her, Dr. Michael Borack wrote in a hissy fit diatribe the following PAS recommendations:

" 'I recommend that ... Barbara Boat, Ph.D., and Erna Olafson Ph.D.... work with these children ... The objectives of this intervention will be to de-program the children in regard to their father,...' "
"Drs. Boat and Olafson are also being asked to work with the (redacted) children to assuage any fears and dissuade any false beliefs they might have acquired about their father as a result of their mother's long-term campaign against him."
"I recommend that all contact between (the mother) or her family members and the involved minor children be supervised by a neutral professional until the Court has the opportunity to investigate this matter further."

The alleged abuser Mr. Thibodeaux canceled the next scheduled appointment the children had with Drs. Boat & Olafson. Never again would Dr. Thibodeaux return with the children to the court recommended therapists Boat & Olafson. He failed to fully co-operate with Panioto's court. There is no penalty for that. Panioto is there to help, not hurt, alleged abusers.

So Dr. Borack insultingly accused Dr. Olafson of being manipulated by the mother, just as he had accused Dr. Kowalski of the same. (But the incompetent Borack was not being manipulated by Mr. Thibodeaux, was he?)
The PAS psychologist Dr. Michael Borack unethically sought to silence a strong opinion contrary to his own.
To somewhat get around this obstacle, Dr. Barbara Boat co-authored a report with Dr. Olafson and then penned one of her own.
It is unknown what a solo Dr. Erna Olafson report might read like if not handcuffed by the unethical Panioto Court psychologist, Dr. Michael Borack.

Michael Borack was interviewed on 3-27-01 by New York investigative journalist and author Karen Winner. The interview turned into a physical confrontation as Dr. Michael Borack seized, then destroyed the audiotape 45 minutes into the interview.
Dr. Borack threw the audiotape into the trash and blocked Ms. Winner's access to it. Ms. Winner sustained scratches and has a witness to the scuffle.

In the impromptu meeting with Zuberbuhler, it was represented to the mother's attorney that his client was apparently mounting an attack on PAS psychologist Michael Borack and PAS Judge Ronald Panioto.
The mother's attorney Bill Abernethy left the meeting, and a few hours later, without even hearing the Winner side of the Borack interview and scuffle, withdrew from the case. Abernethy had been previously advised that Karen Winner was coming to Cincinnati to conduct interviews, and had himself received written permission to speak with Ms. Winner. Like a deer caught in the headlights, Billy boy cut and run.
As a direct result of Panioto aide Jayne Zuberbuhler's interference with the mother's attorney, and at a very critical juncture in this case, following the Boat & Olafson Reports, the mother lost her legal representation. Of course that was probably a good thing, because the last thing Bill Abernethy is, is a trial attorney. A fella needs steady legs for that.

In other words, ethical principles and Ohio law are not one and the same. Entirely possible for an Ohio psychologist to break most of the APA ethical codes and still not run afoul of the Ohio State Board of Psychology. Unless a fella steals money or has sex with a client, he can do the shit Borack does.

Without even ruling on a motion previously submitted by Michael Borack to quash his deposition, Judge Ronald Panioto attempted to convene a trial in August 2001. He wanted to stick it quick to the mother who involved a reporter. Lot's of people showed up. What a waste of everyone's time and money.
The mother's new attorney Richard Ducote enlightened Judge Ronald Panioto that his client had a constitutional right to first depose the Hamilton County Domestic Relations Court Parental Alienation Psychologist - Michael Borack. Panioto retreated from stepping on this woman's constitutional rights - for awhile anyway.
Michael Borack, forced by constitutional law into deposition, did not survive it.

Minimizing An Allegation
From 800 Miles Away
Mr. Thibodeaux's parents unfortunately have passed away. He has only one surviving sibling, an older homosexual brother, who had once been arrested for masturbating in a New Orleans department store restroom while spying on men peeing.
Now imagine this man babysitting your child? Panioto & Borack have no problem imagining it. Because of Borack, Panioto & Shattuck, Mr. Thibodeaux's brother is able to see the children more frequently than their protective mother, who is now helpless to safeguard her children from him.
When the little boy in this case was just shy of three years old, he disclosed possible sexual abuse of him by Mr. Thibodeaux's brother. What happened is that the mother and father in this case had gone out for the evening in New Orleans leaving the boy in the care of the paternal grandmother, who in turn left the boy in the care of the boy's uncle and his boyfriend. The boy woke up in the middle of that night distraught and inconsolable.
Sensing something wrong, the mother caught the first flight home in the morning to Cincinnati with her son, leaving the father behind. Once in Cincinnati, the boy revealed that his uncle and the uncle's boyfriend had stripped naked - and had done the same to him. Upon returning home from the store, Mr. Thibodeaux's mother encountered the situation and chased her grown naked son and his boyfriend from the house, throwing pillows and anything else she could find at the two alleged perverts. They ran scooping up their clothes as they hustled out the back door.
Now here is what the Hamilton County PAS psychologist Dr. Michael Borack, a non-expert in child sexual abuse, wrote about the incident, turning it against the Mother.

"Mrs. Thibodeaux said that when her mother asked (the little boy) what he had done during his trip, he answered that he and his Uncle had 'pee-peed' on each other. This is quite an unusual statement. If (the boy) had indeed said this, it certainly would be cause for concern and further questioning. But, young children do say odd things, so an experienced parent would know to investigate the matter further before reaching absolute conclusions. Mrs. Thibodeaux said she, 'ran upstairs and had the dry heaves.' Again, this account gives one an uneasy sense. It sounds unnatural and melodramatic."

Actually, Mr. Borack's reaction is unnatural. Only after the fact did everyone learn his true melodramatic, fabricating nature. Borack should be flipping burgers, not writing psychological evaluations. 
Of Sociopaths, Artful Manipulators
And Superb Balance 
"(The father) did come across as mildly defensive - but this is an appropriate stance for someone in his circumstances. Had he been highly defensive, this would have been suspicious in and of itself, {as the guilty - excepting sociopaths - usually project that guilt into a sense of being attacked}. However, had he been completely at ease and non-defensive, this too would have raised some suspicion. ... Altogether, (the father) would have to be a remarkably artful manipulator to strike such a superb balance. It is not easy for perpetrators to dupe someone who is highly trained and experienced with identifying their manipulation and deceit."

If a pedophile doesn't come right out and admit it, no psychologist, especially non-experts like Borack, can ethically state that it didn't happen based upon sessions with the accused.
There are no psychological tests that can be performed on an alleged child molester that can prove the person did not molest a child nor predict that a person will not in the future.
True experts in the field know that child molesters are notoriously cunning and persuasive. It is how they lure their victims and hide their crime.
As for artful manipulation, Mr. Thibodeaux had in fact once cleverly duped the Hamilton County Parenting Division in December 1997 into believing that Mrs. Thibodeaux had visited a psychiatrist several times. In doing so, Mr. Thibodeaux insinuated that the mother was unstable and must be crazy.
To prove his point, Mr. Thibodeaux waved an insurance bill in front of the Hamilton County Parenting Specialist which showed that Mrs. Thibodeaux was the policy holder for the psychiatrist visits. But Mrs. Thibodeaux had never visited a psychiatrist. She could not explain the insurance bill to the Specialist, who just inches from the mother's face barked, "Explain this". Her inability to do so resulted in more favorable treatment from the Parenting Division toward Mr. Thibodeaux and probably caused them to believe that she was less than honest, when in fact it was the opposite.
Three months later and after the Specialist wrote her "Alienation" report to the Court, the mother finally received the insurance company documents pertaining to the controversial psychiatrist sessions. The documents revealed that the psychiatry firm's patient for all the sessions was ... Dr. Louis Thibodeaux.
Mr. Thibodeaux performed this little trick with "superb balance", perhaps even laughing all the way to his car.
I'm No "Monica Lewinsky"
The Hamilton County Parenting Division went on to allow as the visitation supervisor Mr. Thibodeaux's then girlfriend, Kelly Reichert, who would become his second wife and third mother to a third and fourth son (you need a scorecard).
Mr. Thibodeaux correctly described the Parenting Division rules as a "joke" as he openly complained that the Hamilton County Parenting Division had set no guidelines as to who could supervise an alleged child molester? On that, he probably has a point.
Given the alleged lack of direction, Mr. Thibodeaux chose a woman he described to Dr. Jacqueline Kowalski in December 1997 as his "lover".
Despite having lived together for several months, on February 3, 1998, while testifying as Mr. Thibodeaux''s visitation supervisor, and in his favor, the future second wife denied under oath that a romantic or sexual relationship existed between them with these answers:
"Absolutely not." and "I'm not following Monica Lewinsky here." 
Kelly Reichert admitted to doing Mr. Thibodeaux's laundry and baking cookies for him. She also stayed overnight in the home even when the children were not present. Now that's one heckuva supervisor.  
Despite this, Mr. Thibodeaux incredibly denied that he ever told Dr. Kowalski that his visitation supervisor was his "lover" and repeated under oath his second wife's unbelievable story. Denying the obvious, Louis Thibodeaux basically called the therapist, who is a nun, a liar.
Imagine that - calling a nun a liar and expecting people to believe you instead? Who is telling the truth here?
Would Mr. Thibodeaux, who had numerous adulterous affairs, abstain for several months from having sex with a 29 year old woman with whom he was sharing his home and who would later coincidentally become his second wife?
Or is the nun telling the truth?
